  1. The Program. The Rocking Romans Citizen Program (hereafter "Program") is a fund-raising program supported by Rocking Romans (hereafter "Company") for the benefit of Catholic organizations. Purchases made on the Company's web site in connection with Rocking Romans Citizen (hereafter "RRoC") codes will be tracked by the Company. On a quarterly basis, a portion of the purchases made under each RRoC code will be sent to the organization that has been granted the use of that code. The Program can be changed at any time by the Company, without written, electronic, or other forms of notice. Acceptance of the stipulations of this Terms and Conditions Agreement is required for an organization's request for inclusion in the Program to be granted by the Company. These Terms and Conditions may be modified to reflect changes in the Program at any time.
  2. Portion Rate. The current fund-raising portion rate is set at 50% of 2009 Best of New Catholic Music compilation purchases and 25% of all other music purchases made on a quarterly basis under each RRoC Code. Shipping charges, handling costs, and sales tax will not be included in total purchase amount when portion rate payments are calculated. These rates are subject to change at any time as deemed necessary by the Company. The Company will make reasonable efforts to alert Program participants to changes in portion rates made in the future. A minimum total purchase amount of $50 USD must be accumulated under a RRoC code in any particular quarter for the portion rate amount to be sent to the organization that is using the RRoC code. This minimum purchase threshold is subject to change at any time. The Company will make reasonable efforts to inform Program participants about changes in minimum purchase thresholds. Program participants are not guaranteed, or otherwise entitled, to receive a portion payment. At its sole discretion, the Company reserves the right to discontinue the forwarding of portion payments, temporarily or permanently, to one or all Program participants.
  3. Forwarding of Portion Payments. Portion payments will be sent, or otherwise forwarded, to Program participants at the address provided in the participant's RRoC application. Changes in contact information and mailing address must be communicated to the Company electronically. The Company cannot be expected to seek new contact information for a Program participant if mail sent to the Program participant is returned to the Company as undeliverable.
  4. Program Applications. Admission into the Program is based upon application review by the Company. The Company reserves the right to accept or deny any application without explanation.
  5. Continued Participation. Acceptance into the Program is not a guarantee of continued inclusion in the Program. At its sole discretion, with or without explanation, the Company can dismiss Program participants from the Program at any time for espousing views or conducting activities not in support of the Catholic Church's teachings or for any other reason.
  6. RRoC Code Use. In order for purchases to be tied to any RRoC code, that code must be entered at the time of purchase. A RRoC code cannot be applied retroactively to a purchase. Any person can use a RRoC code when making a purchase. A RRoC code can be used anywhere in the world that a customer is located when making a purchase on the Company's web site. Each RRoC code is unique. Some RRoC codes may be very similar, so the Company urges precision for customers who enter a code when making a purchase. The RRoC code entered at the time of a purchase is the code that will be credited with the amount of that purchase. A RRoC code for a particular purchase cannot be changed retroactively. If a Program participant is dismissed from the Program, its unique RRoC code will be suspended and will not be accepted by the Company's system if entered for purchases made after the date of dismissal from the Program. Customers of the Company can use only one RRoC code per purchase but can use a different RRoC code on one, or every, future purchase made on the Company's web site. The Company reserves the right to change RRoC code assignments for Program participants at its sole discretion.
  7. Public Nature of RRoC Codes. RRoC codes can be found via search function on the Company's web site and can be readily associated with the Program participant to which they are assigned. RRoC codes typically will be distributed widely by Program participants to members, supporters, friends, friends of friends, and others not defined herein. The Company owns all RRoC codes with regards to its Program administration, systems, databases, marketing, promotions, and other uses specific to the Program, but it allows Program participants to use them at the Company's sole discretion. The Company does not hold RRoC codes, or the name of the Program participant that utilizes a particular code, to be confidential, secret, or otherwise privileged information. Individuals and institutions can disclose RRoC codes to others, so long as said disclosure is made in a way that respects the dignity of its recipient. The Company does not support the use of spam methods for the dissemination of RRoC codes.
  8. Program Partners. The Company reserves the right to allow the collaboration of partners in the operation of the Program. Third party service providers, promotions groups, publicists, bill payment services, and others may be utilized in support of the Program. Partners will be bound by the same privacy standards as the Company in protecting the non-RRoC code/organization name information utilized in the administration or promotion of the Program
  9. Warranties and Guarantees. The Company makes no implicit or explicit warranties or guarantees whatsoever related to the Program.
  10. Limitation of Liability and Indemnification. The Company accepts no liability related to an organization's participation in the Program. Program participants also agree to indemnify or otherwise protect the Company from legal or economic claims against the Company that might arise from an organization's participation in the Program.
  11. Severability. If one or more sections of this Terms and Conditions Agreement are deemed unenforceable, the other sections will remain intact.
  12. Jurisdiction. This Terms and Conditions Agreement is established under the laws of the state of Georgia, USA.
